7.3 Maximum Liability

IN NO EVENT SHALL THE TOTAL LIABILITY OF GETUPDEALS TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

9. Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

1. Negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation.
2. Mediation: If negotiation fails, the parties shall attempt to resolve the dispute through mediation in Mumbai, India.
3. Arbitration: If mediation fails, the dispute shall be finally settled by arbitration in Mumbai, India in accordance with the Arbitration and Conciliation Act, 1996.

You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.

11. Miscellaneous Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the sole and entire agreement between you and GetUpDeals regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

11.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
